Two U.S. lawmakers are pressing the Federal Trade Commission to examine the murky world of online real estate referrals. Representatives Jennifer McClellan and Don Beyer have formally urged the agency to investigate how real estate brokerages and third-party websites generate and sell consumer leads. Their concern centers on practices where potential home buyers and sellers are unknowingly routed to agents based on financial agreements rather than service quality.
In a letter to FTC Chair Lina Khan, the representatives argue that many referral platforms operate without clear disclosure. Consumers often assume they are receiving unbiased recommendations, but the lawmakers allege that these leads are frequently sold to the highest bidder. This system, they claim, drives up costs for consumers and undermines trust in the housing market. The letter specifically points to "pay-to-play" models where agents must pay hefty fees to appear in search results or receive client contacts.
The push comes amid broader scrutiny of the real estate industry, including ongoing antitrust litigation and changes to commission structures. McClellan and Beyer suggest that the current referral ecosystem may violate consumer protection laws by hiding material connections between the platform and the referred agent. They want the FTC to determine if these practices constitute deceptive or unfair acts under federal law.
The FTC has not yet publicly responded to the request. However, the agency has previously signaled interest in cracking down on hidden fees and misleading marketing in the housing sector. For now, the lawmakers are waiting for the commission to take action, warning that without intervention, consumers will continue to pay inflated costs for what they believe is an impartial service.
